International Conference of Jurists on Rule of Law 2007, New Delhi
Chief Justices and judges from over 50 countries took part in the International Conclave of Jurists-2007, jointly organised by International Council of Jurists, All India Bar Association and the Indian Council of Jurists on December 6 2007 AT KAMAL MAHAL, HOTEL MAURYA SHARATON, SARDAR PATEL MARG, New Delhi
Chief Justice of India K.G. Balakrishnan welcomed the judges at the conclave which was attended by Bar leaders and academicians from different countries. The Chief Justice of Uganda, B.J. Odoki, commended the ICJ for bringing the legal fraternity together. President, Haute cour de justice, Benin Clotilde M. Nougbode, said the members of Bar associations were one family and stressed the need to safeguard the interest of the future generation.
Acting Chief Justice of Afghanistan Bahauddin Baha said he was honoured to be in India. He said justice broug ht security which in turn “brings prosperity for the people.” Chief Justice of Mauritius Yeung Kam John Yeung Sik Yuen commended the ICJ for bringing the stalwarts of law together through this conclave.
Supreme Court Bar Association president P.H. Parekh and special invitee M. Ravindran welcomed the judges and delegates. ICJ president Adish C. Aggarwala applauded the role played by the judiciary in the world for implementing the rule of law and for protecting human rights.
ICJ organising secretary S. Prabhakaran regretted that lawyers were being subjected to attacks in different parts of the world. Stressing the need for strengthening the relations between the Bar and the Bench, he said if the relations strained, then the Bench would be isolated and that would not augur well for the judiciary and the rule of law.
The former Chief Justice, P.N. Bhagwati, said the judges throughout the world were working to achieve the common cause of justice. He said: “Judges and lawyers are servants of the people. Inaugurating the International Conference of Jurists on ‘the Rule of Law’, the President said, “even though free legal aid is guaranteed for the weaker sections of society, it should be remembered that the quality of legal aid plays a very important role. Creative solutions to this problem will have to be thought of.” Pointing out that sometimes justice delayed could become justice denied, she said there was a need to ensure speedier disposal of cases.
“In a country with the size and magnitude of India, there remain many challenges in providing social justice as well as justice to the marginalised sections of our society. High cost of judicial remedy is a cause for concern and needs rectification. Alternative dispute settlement systems need to be encouraged. We need to reinforce our efforts for the better implementation of the rule of law particularly for the disadvantaged sections of society.”
The President said challenges to the rule of law would also include problems of international terrorism, a global economic order that did not have adequate representation in international financial institutions for developing countries, weapons of mass destruction, and transnational crimes such as drug trafficking and money laundering.
Chief Justice K.G. Balakrishnan, who presided, said: “We must not forget that the forces of fundamentalism, extremism, internal terrorism are prevalent at least in some parts of this country. The traditional approaches to reducing the crime and violence based on increasing mechanism and control and harsher sanctions have failed to reduce crime.
It is true that in this country the judiciary has a great role of play but the existence of a good judicial system is not enough to protect citizens against abuses of state power. Adequate laws and institutional mechanisms are also needed. Only administration based on good governance can maintain the rule of law in this country.” Referring to Friday’s bomb blasts in Lucknow, Varanasi and Faizabad, the Chief Justice of England and Wales, Lord Phillips of Worth Matravers, said terrorism posed a serious challenge to the rule of law. The President of the International Bar Association, Fernando Pombo, and the President of the International Council of Jurists, Adish C. Aggarwala, explained the significance of the conference.
On this momentous occasion, the International Council of Jurists conferred the INTERNATIONAL JURISTS AWARD-2007 on eminent jurists who have made a mark in their respective fields of law and have shown the way for others to follow. These awards were given to Her Excellency the President of India Ms. Pratibha D. Patil, in recognition of her contribution as guardian of constitution. “The International Council of Jurists is a body of jurists working towards promotion of administration of justice and healthy development of law, suitable to social and economic needs of the people. The Council is actively involved in organizing campaigns for legal awareness and information to be used as a tool for advancement of public good. The Council intends to promote rule of law and social justice by making provision of free legal aid and by maintenance of an efficient system of legal advice.”
